A new deadline of October 31, 2026, is set for the City to obtain lawful possession through eminent domain for certain parcels, after which completion of public infrastructure for those parcels will not be a condition precedent to a Temporary Certificate of Occupancy.
  • Assignment: Clarifies that the agreement is personal to the Owner and prohibits relinquishing control of the Complex Site, Project Improvements, or Property without prior City approval, defining "control" as the power to direct management and policies.
  • Default: Adds a new condition for default related to the Owner or its counterparty's default under leases or contracts that satisfy the Owner's obligation to maintain "control" of the Complex Site.
  • Construction Schedule: Replaces the existing Project Construction Schedule with an updated one attached as Addendum 1.
