By accessing or using motioncount.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.
1. About MotionCount
MotionCount is operated by MotionCount LLC, a California limited liability company. MotionCount is a municipal intelligence platform that monitors city council proceedings across 100+ U.S. cities and delivers actionable procurement intelligence to businesses. We aggregate publicly available government data — agenda items, votes, contract awards, engineering amendments, and legislative actions — and organize it into searchable, structured intelligence products.
Our products include territory intelligence briefs, keyword-based alerts and digests, a monitoring dashboard, published intelligence reports, and a free public search tool.
2. Your Data
We collect only what's necessary to operate the service.
- Account information — Email address for authentication and alert delivery
- Alert preferences — Cities, keywords, and delivery frequency you configure
- Contact form submissions — Name, email, and message content when you reach out
We do not sell your data. We do not track you across the web. We do not share your information with third parties except as required to operate the service (email delivery infrastructure) or as required by law.
You may request deletion of your account and associated data at any time by contacting sales@motioncount.com.
3. Source Data & Accuracy
MotionCount aggregates data from official government sources including municipal agenda portals, meeting minutes, and public records. While we work to ensure accuracy:
- Source data may contain errors originating from government websites or agenda management systems
- AI-generated summaries and analysis are assistive and interpretive, not authoritative
- Dollar values, contractor names, and dates are extracted from agenda items and may reflect proposed rather than final figures
- Official meeting packets, adopted ordinances, and executed contracts remain the definitive source for any business decision
Disclaimer: MotionCount provides intelligence as-is for informational purposes. We are not liable for business decisions made based on our data, analysis, or reports. Always verify material business decisions with primary government sources.
4. Published Reports & Content
MotionCount publishes intelligence reports on our website covering municipal procurement activity, infrastructure pipelines, and public affairs signals. These reports are free to read and download.
What you may do with published reports:
- Read, download, and share reports for internal business use
- Reference findings in your own internal presentations, memos, and strategy documents
- Quote limited excerpts (with attribution) in articles, blog posts, or social media
- Link to reports from your own website or publications
What you may not do with published reports:
- Republish reports in full or in substantial part without written permission
- Resell, redistribute, or sublicense report content as your own product or deliverable
- Remove MotionCount attribution or branding from downloaded PDFs
- Use report content to train machine learning models or for automated data extraction at scale
Attribution requirement: When citing MotionCount reports externally, attribute to "MotionCount" or "MotionCount Municipal Intelligence" with a link to the report URL where possible.
5. Territory Briefs & Custom Deliverables
Territory intelligence briefs are custom reports prepared for individual clients on request. These are delivered directly and are subject to the following terms:
- Internal use: Briefs are licensed for internal business use by the purchasing organization. You may share them within your company, use them in internal strategy meetings, and distribute to employees and direct contractors.
- No redistribution: Briefs may not be resold, published, or redistributed outside your organization without written permission from MotionCount.
- Derivative works: You may create internal documents, presentations, and analyses that incorporate findings from your brief. The underlying intelligence and compilation remain the intellectual property of MotionCount.
- Accuracy: Briefs reflect municipal activity as of the date of preparation. Municipal proceedings change. Briefs are a snapshot, not a guarantee of future procurement outcomes.
6. Platform & Search
The MotionCount search tool, meeting pages, matter timelines, and city pages are available to browse without an account. Authenticated accounts provide access to keyword alerts, dashboards, and additional features.
Access tiers and feature availability may change. We will notify registered users of material changes to their account capabilities.
7. Acceptable Use
You MAY:
- Use the platform and reports for business monitoring, research, and competitive intelligence
- Share intelligence internally with your team and organization
- Use data for due diligence, compliance, and market analysis
- Cite MotionCount with attribution in external publications
- Link to MotionCount pages, reports, and meeting records
You MAY NOT:
- Resell, repackage, or white-label MotionCount data or reports without written permission
- Scrape, crawl, or systematically download content beyond normal browsing use
- Create multiple accounts to bypass usage limits or access controls
- Use the platform or its data to harass, threaten, or target public officials or private individuals
- Misrepresent MotionCount data or present AI-generated analysis as official government records
8. Intellectual Property
The underlying government data aggregated by MotionCount is public information. MotionCount's intellectual property consists of:
- Compilation and organization — The selection, arrangement, and normalization of municipal data across jurisdictions
- Analysis and interpretation — AI-generated summaries, procurement signal classification, pipeline assessments, and competitive intelligence derived from source data
- Report structure and presentation — The format, narrative structure, and analytical framework of published reports and territory briefs
- Platform and interface — The MotionCount website, search tools, dashboard, and alert system
You are always free to access the same underlying public government data directly from official sources. Our terms govern the use of MotionCount's compiled, analyzed, and structured output — not the public facts themselves.
9. Limitation of Liability
MotionCount is provided "as is" without warranty of any kind, express or implied. We do not guarantee completeness, accuracy, timeliness, or uninterrupted access.
In no event shall MotionCount be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, reports, or any intelligence products. Our total liability for any claim shall not exceed the amount you paid to MotionCount in the twelve months preceding the claim.
10. Changes to These Terms
We may update these terms as our products and services evolve. Material changes will be noted by updating the "Last Updated" date at the top of this page. Continued use of MotionCount after changes constitutes acceptance of the updated terms.
