PETITION TO AMEND THE NEW HAVEN ZONING ORDINANCE MAP TO CHANGE THE ZONING DESIGNATION OF 18 TOWER LANE AND 1B TOWER LANE FROM PLANNED DEVELOPMENT DISTRICT #15 TO THE BD-3 DISTRICT CENTRAL BUSINESS/MIXED USE.

OR-2026-0006

Summary

This petition seeks to amend the New Haven Zoning Ordinance Map to change the zoning designation of 18 Tower Lane and 1B Tower Lane from Planned Development District #15 (PDD #15) to the BD-3 District Central Business/Mixed Use. The New Haven Jewish Community Council Housing Corporation is proposing this change to facilitate the construction of a new building, Tower Three, which will provide 140-200 units of assisted living and supportive housing for elderly and low to moderate-income residents. The current PDD #15 zoning, established in the late 1960s, is no longer suitable for the proposed development, particularly as required open space provisions can no longer be met due to the demolition of adjacent parcels. The BD-3 District is preferred as it permits assisted living as a matter of right, allows for dense development, and is compatible with the surrounding zoning. This project aligns with Vision 2034, New Haven's Comprehensive Plan of Development, specifically Strategy 7.6 which prioritizes projects combining affordable housing with long-term care services.

Citizen Impact

This zoning change will enable the development of a new assisted living facility, Tower Three, providing much-needed housing options for elderly and low to moderate-income residents. The project is expected to generate construction jobs and increase the city's tax base through permit fees and property taxes.

ORDINANCE AMENDMENT OF THE NEW HAVEN BOARD OF ALDERS ADOPTING THE CGA STATE STATUTE, CHAPTER 420H, REGULATION OF ADULT-USE CANNABIS, SEC. 21A-420C LICENSE REQUIRED FOR SALE, OFFERING, OR DELIVERY OF CANNABIS. PENALTIES. ENFORCEMENT POWERS OF THE COMMISSIONER, ATTORNEY GENERAL, AND MUNICIPALITIES.

OR-2025-0024

Summary

This ordinance amendment allows the City of New Haven to adopt and enforce Connecticut General Assembly (CGA) State Statute, Chapter 420H, specifically Section 21A-420C, concerning the regulation of adult-use cannabis. The amendment empowers the city to impose civil penalties for violations related to the unlicensed sale, offering, or delivery of cannabis. This includes significant fines for individuals and businesses found in violation, as well as for those who aid or abet such violations, or knowingly make property available for illegal cannabis activities. The city can also seek court orders to seize merchandise and proceeds related to these violations. This action aligns New Haven's municipal code with state law to enhance local enforcement capabilities, safeguard public health and safety, and ensure compliance within the regulated cannabis market.

Citizen Impact

This ordinance empowers the city to issue significant civil fines (up to $30,000 per day for direct violations, $10,000 for property owners) for unlicensed cannabis sales, offering, or delivery. This aims to curb illegal operations and protect public health and safety, potentially leading to a more regulated and secure local cannabis market.
