This ordinance amends city code to allow publicly accessible electric vehicle (EV) charging equipment to encroach into public rights-of-way. This is enabled by:

  • Ordinance Amendment (Attachment 1): Modifies Section 5-2-29 to permit EV charging equipment installations, subject to permit requirements and specific conditions outlined in the "City of Alexandria EV Charging Requirements" (Exhibit B).
  • Fee Resolution (Attachment 2): Establishes fees for these encroachments, including a $100 Permit Processing Fee and an Annual Charge of $1.50 per square foot of occupied right-of-way, plus $140 per designated EV Charging Only parking space.
  • License Agreement (Attachment 3): Outlines the terms for a revocable, non-exclusive license for entities (Licensees) to install and operate EVSE. The initial license term is 5 years, with Licensees responsible for all costs, maintenance, and insurance. The agreement details siting restrictions, equipment standards, payment methods, and data sharing requirements.
  • Parking Ordinance Amendment (Attachment 4): Adds Section 10-4-48 to Title 10, establishing a $25 fine for parking in spaces reserved for EV charging if the vehicle is not a plug-in electric vehicle or is not actively charging.
